Terms of Use and Privacy Policy

These Terms of Service (or “Terms of Use” or “Terms and conditions”) and Privacy Policy ("Terms") govern your use of TopicNest, a product of Stratolia SAS. By accessing or using TopicNest, you agree to comply with these Terms. If you do not agree, please refrain from using the service.

1. User Data and Privacy

1.1 Data Collection

• TopicNest collects user data, including but not limited to audio files, transcriptions, and account details. This data is stored on secure servers rented by Stratolia SAS.

1.2 Data Usage

• User data will not be resold. It will only be analyzed for the purpose of improving service quality and adapting the interface and features based on user preferences.

1.3 GDPR Compliance

• TopicNest complies with the General Data Protection Regulation (GDPR). Users have the right to:

  • Request data deletion.
  • Rectify inaccuracies.

2. Service Scope and Limitations

2.1 Scope of Services

• TopicNest provides transcription, semantic search, topic clustering, and custom AI prompts. Some of the services might not be available immediately but will be added.

2.2 Accuracy and Limitations

• TopicNest supports most languages but does not guarantee transcription accuracy.
• TopicNest disclaims liability for transcription errors or any consequences arising from them.

3. Payment and Subscriptions

3.1 Subscription Model

• TopicNest operates on a subscription-based model. Users can cancel their subscriptions anytime and retain access until the end of the billing cycle.

3.2 One-Time Payment Option

• A one-time payment option is available for a limited time. Refunds are possible up to 80% of the payment, minus the equivalent cost of the standard subscription multiplied by the duration of usage. Refunds are capped at 80% of the total payment.

3.3 Free Trials

• TopicNest offers free trials with defined limits. Details of the trial are available during registration.

3.4 Refund Policy

• Monthly subscriptions are non-refundable. For one-time payments, refunds are subject to the conditions outlined in section 3.2.

4. Liability and User Responsibilities

4.1 User Responsibilities

• Users must:
  • Not upload illegal content.
  • Ensure they have the rights to upload and use the content on TopicNest.

4.2 Liability Disclaimer

• TopicNest is not liable for:
  • Errors in transcription.
  • Misuse of the service by users.

5. Dispute Resolution and Governing Law

5.1 Governing Law

• These Terms are governed by Swiss law.

5.2 Dispute Resolution

• Disputes will be resolved through small claims courts or arbitration in Switzerland, depending on the nature of the dispute.

5.3 Claim Timeframe

• Users must bring claims within 30 days of the dispute arising.
